You follow the legal procedure in your state for eviction based upon non-payment of rent. Some areas require a notice first, others areas allow you to file immediately.
There is no other way. Self-help methods will get you sued, arrested or both.

I too recommend using a real estate lawyer for this process. I have both done it myself and used a lawyer. The lawyer cost me about $250 and saved me much time and hassle. At least here in Milwaukee the law is very specific and seems to favor tenants. One minor mistake can keep your tenants in your house longer. For instance, the first time I had to evict a tenant I sent the 5 day notice to pay on the 6th of the month instead of the 5th and it cost me 30 days.

If you've never evicted anyone before, then immediately higher a good attorney who specializes in real estate law. It's too easy to make a costly mistake your first time through this process. Pay close attention, and maybe next time you'll be ready to handle court and the eviction processes without a lawyer. For now, don't risk it. Good Luck!

Go to the clerk of court for your county.Pay a small fee and have them served with an eviction notice for nonpayment of rent. I assume you have sent a registered letter to them a ''Demand of payment letter". Then you will go to small claims court which is no big thing.

Give them a 30 day pay or vacate letter make sure you mail it to them certified then check out the laws where you live for landlords laws

If the tenants have children it's not going to be easy. I'm sure the laws differ from state to state. You'll have to check and see what procedure you have to follow in your state.
