I tried to withdraw money from an atm machine and on the first try it told me i was declined. I knew there was money in my account so i tried again and it worked and gave me my money. When i got home i checked my account online and it showed a double withdrawl for the same amount, one for the first one that was declined and the second that was approved. The bank is giving me a really hard time about giving me my money back even though I produced the first reciept showing declined and the second one that was approved. What can I do?

The first time it said declined, if the bank was opened you should have walked in and immediately made a point that this was incorrect. If the bank wasn't open at the time, the very second it next opened you should have been there front and center, having already mailed out a letter about the situation, complained online, and complained on the phone immediately.

Now you are unfortunately just going to have to wait for the grinding wheels of bureaucracy.

If you have your receipts, that's proof enough that you were declined the first time. That happened to me while living in Mexico and I emailed the bank. Those machines have an amazing 'memory'. My account was credited for the full amount, but it took 2-3 weeks to get it straightened out, so don't worry.

Sorry, but I think you're lying. I have had this happen to me, where I thought I entered the wrong pin number or something, and I STILL got declined a second and in some cases a THIRD time.
So if your bank is issuing money from atm's after the second or third time, there's a problem with the machine.

And no, I don't think the bank owes you anything.

Keep calling the bank and ask for the Manager or the highest person in charge. If they don't help then report the bank to the FDIC (be sure to explain your case clearly and include photocopies of your ATM receipts). You can also file a claim in small claims court. If your local TV station has one of those consumer reporters then email your case to them too.

I work for bank. I did encounter clients with same issue awhile back. Honestly, this will take awhile for investigation before they can credit back money to you.

Did you withdraw the money from your own banks' ATM? or u just get your money from an ATM other than your bank? This is an important question.

It is much easier to do investigation on your own bank's ATM. For your reference, this is NOT branch's fault. It is the ATM system has probelm which the branch has no control over it. The banks' ATM department uses different system and they are the one responsible to credit u back. So, when u go in to branch. DON'T GET MAD at the branch staff. Otherwise, you WILL NOT get ANY help. The branch staff may help you to reflect this issue to the ATM department FOR COURTESY purpose ONLY. I am saying courtesy because you basically don't have a valid proof to back up your case. Even you write a complain letter to CEO, branch staff still can say you don't really have proof. And if I am a CEO, I will just think you are a trouble client and simpily give up the banking relationship with u.

Anyway, please do the followings. It can help fasten the process:

- ONE, you should write a letter and tell your story. Attach copy of your receipts. As a banker, I will not take you seriously unless you have something in black and white. And just skip the banker and go straight to manager.

-TWO, most of major banks have a form for filing about unauthorized transcation. They may need you to have notary public to notarized and sign on the form. The bank staff then will send out to investigation department to follow up. And you should receive a call from investigation department within 2-3 weeks.

-THREE, ask the branch staff to check their ATM cash dispense balance on the day you didn't get ur cash from ATM. Since you didn't get ur cash while ATM recognized it as valid withdrawl. I assume their ATM cash dispense was not balance on that day.For instance, if you didn't get yout $20. The branch's ATM dispense balance on that dat should be $20.00 over. If the branch staff can trace that, it will make your case MUCH MUCH easier to solve.

- Bank DOES NOT watch the video tape for case like this. Tapes are only being used when authority ask for it in the case like crime or bank robbery!
- Try to be clam and reasonable. If you storm in the bank and ASK FOR YOUR MONEY. I am sure you WILL NOT get it. Bank prefer to lose a customer than going through all these trouble. Bank doesn't make much money from customer who has $5000 in checking account or $100000 from CD (bank only get about 0.5% from that balance. Bank doesn't make money from CD or saving acct).
-You sure will lose your case in court. One thing you don't have is evidence. Bank is just protect for risk management purpose. They will not get penalized. Even if they lose the case, you get your money back ... which is much less than the money u paid to ur attorny and the time u spent.

All ATM's have little camera's pointed from the inside to the person who is making a transaction.Ask the bank(a supervisor specifically) to look at the tape and see what you did and compare that to your reciepts.

They will eventually add up the total cash dispensed and the total receipts and the difference should be what you did not get. If your account shows an extra debit for X dollars and the ATM is over by X dollars then it should pretty well verify what you are saying.

At my bank, I'm in charge of the ATM. It is balanced everyday. Go find who takes care of the ATM, tell that person your problem. When they go to balance it, they can see where the mistake is. Depending on the financial institution, there may be some paper work.

was the atm from your bank or one of those others like in the 7-11's? you have to contact the atm company for that particular atm. check to see if there is a number on the atm and see if they can help you. that really really sucks. a debtor charged me twice but my bank(wachovia) resolved the problem quickly. best of luck if all else fails that a baseball bat to that damn atm machine!
