Can a person have probation in one state and request to serve probation in another state?...Here's the situation, my friend caught a charge in Missouri and mostly will be receiving probation in Missouri. His home is in Virginia. Can he worked something out with the D.A., judge, or probation officer to serve his probation in Virginia, his hometown. Please give accurate feed back. Thank you

Yes, but...

There are a couple of things: first, he has to get permission from the court that sentenced him. So he'd petition the court for a move of probation

AND

Virginia would have to accept him for probation. See, they will have to add him to a probation officer's caseload, and before they will be willing to do that, they will want to know all about him, and if he'd be difficult to supervise.

So, if it's ok with the judge, and ok with Virginia, then he can do it.

I don't know for sure,, but it wouldn't hurt to ask. I don't think it likely, however, as you would have to get Missouri to Cooperate with Virginia, and get a Virginia parole officer to cooperate. States like to protect their turf, especially in legal matters. Plus Missouri probably would want to keep a close watch on your friend during probation, as that state is primarily responsible for holding him accountable. I'd tell your friend to plan on staying in Missouri for a long while, until he has successfully completed his probation. Of course, if there are extenuating circumstances and the court is willing, it won't hurt to ask.

It is possible, but it is up to the state of Missouri to apply to the state of Virginia to have the probation transferred. It is a very long process.

While his probation will be for the state he comitted the crime, he can have a local probation officer that will act as a lision between the two.

My friend has this same situation. He is on probation in Georgia but lives in NV now and just reports to the officer in NV.

during sentencing your friend needs to have placed in the record that he is resident of Virginia, then ask the judge can the probation be transferred to virginia. if it is granted the sentence will reflect that probation will be served in virginia.

now, if the judge has already sentenced your friend, he needs to request a transfer through his po. now depending on the rules in mossouri some probation departments can make the decision without letting the judge know. but you have to go through a process called interstate compact. its alot of paperwork and time but it can happen.

it is legal for the person to do so in Virginia ,but he has to go through the probation office first and be given a new one first before leaving Missouri first,it might have to go through the courts as well,wich we all know will take forever,the procession between the courts and the P/Oare a long time in itself but if he can get an appointed P/O that will take him in Virginia then he will be free and clear.I hope it helped and have a great weekend and good luck to your freind doll!!

Yes you can. I was on probation in Indiana and I got it transferred to Illinois. Just ask your probation officer about it, he can give you all the paperwork that you need (trust me there's lots of it!). Hope its the same in your state! Good luck!
