Larry you did not answer the Q asked and you focused on a detail that was put in because the belligerents on all sides rationalize the morality of there actions.

By the way your response did suggest to me another Q and I asked it referring to your Dresden,Hiroshima,Nagasaki examples. TWH 08312006

Namsaev, I know you are biased and an Israeli apologist, but I think both sides will be taken to task for their war crimes. It is estimated that over 100,000 unexploded bomblets from US made cluster bombs remain in southern Lebanon. It will take over a year to clean up and and in the meantime they will kill and maim civilians who want to return and rebuild their homes and businesses. Your anger?,hatred of Palestinians? are biases that blinds you to the truth of the situation which is an unending cycle of vengence and violencs. TWH 08312006

Both sides are wrong in this issue, I think they both should be brought on trial by a UN Council for Crimes Against Humanity. However, the question is are Cluster bombs or Kytusha rocket leftovers war crimes? Then I would say no, its just collateral damage. These things happen, just like the millions of land mines throughout the world right now from eons of conflicts. In a nutshell, the weapons are not a crime, the act of violence and those that use the weapon is the crime. I personally support the condemnation of both Hezbollah and Israel and feel that the only solution is to call in a UN War Crimes council on both parties.

You can't compare apples and oranges.

You drop a cluster bomb on a rocket battery, troop implacement, or supply cache it is a tactical act. If civilians are killed they are collateral damage. Why? Because they weren't the actual target.

On the other hand if you target a town but you have no intention of taking the town and your sole goal is to kill civilians I'd call that a crime.

The whole term war crime is bit of a misnomer. War is war. There are artocities commited in every war. Civilians die in all wars. And under certain circumstances those who commit those acts should be puished.

Is the leader of Hezbollah being brought up on war crimes?

"acceptable and customary"? It's war. Ever heard of Dresden, Hiroshima or Nagasaki? As much as some like to pretend other wise, wars are won when enough civilians and cities are killed and destroyed that the government of the country can no longer sustain the war effort. Anything else just prolongs the suffering. That's why "war is hell".

while techinically it is a war crime for isreal, Hezbollah like Al Qaeda is not a recognized entity by the world court. As such isreal is fighting a guerilla war and just like in Vietnam many "war crimes" will go un prosecuted.
