I have old Nissan 240 Sx, she has honda SUV very new( don't know what-type very big one). We hit back to back . Her right bumper fold in and my right bumper has some fold and scratch. Her is more damage. Anyway, she want to get estimate and settle without using insurance. I don't care about fixing mine. I believe that she really want to fix her but have me pay for it. I don't think that is my fault, am I right? Should I report my insurance so they can take care of it ( deal with her for me)? I am afraid that she might turn around and report to her insurance first and I don't report mine..so then it becomes my fault ? and also will cause my insurance rate to increase . Will it increase- if I just got in accident if not my fault? Please help, I just need to decide ASAP. Thanks.

I think you should report to insurance so that you cover yourself. You should tell other person and report to your insurance.
She is probably asking the same question somewhere here on yahoo and is basing her decision on someone's opinion... you can't really trust a complete stranger.

You should follow the rules and exchange information, cars, licenses, insurance, etc., and then report it accordingly. The purpose of insurance is not only to fix your damages but to also represent you in arranging the settlement. If the other party wants to settle outside of the insurance, that usually means she has something to hide and doesn't want the company involved. If both of you were backing up in a parking lot, then neither of you was paying attention to what you were doing. Since she has the newer and more expensive vehicle, then you have the most to lose. I would definitely have your insurance get in touch with her insurance and let them decide who pays what. Will your insurance rates go up? Maybe, it depends on what they decide about fault. Obviously the other party is afraid that they might be at fault, that is why they don't want to get the insurance involved. Forget about police reports though. It happened on private property and there was no personal injury. The police won't care. You do have to report it to the DMV though.

This happened to me many years ago and as far as fault, it was 50/50. She's wants you to pay for it and not go through insurance because she doesn't want her rates to go up. Just go ahead and report to your insurance, tell them what happened, and if you're not interested in repairing your car, tell them that as well. When the adjuster looks at both cars I believe her insurance is going to have to fix her own car. Why don't you call any insurance company and ask for anonymous advice.

About a light-year ago when I worked in insurance, the car that was in "reverse" was generally considered at fault.
Since you both were backing up, be glad to call it 50/50, hope your insurance company doesn't drop you or double your rate.

IF she makes a claim and you didnt report it your Ins company will try not to cover you. Let me tell you, the estimate she get my be significant. If you think so, report it. IT is 50/50 liability

No fault...let her insurance co. take care of her own car. If there is no police report saying it's your fault, I don't think you should have to worry about it. Talk to your agent.

Check your local laws. Us Texans can get in a lot of trouble for a hit and run in the situation you just described, because we did not report to the police.

here in georgia, the accident happened on private property. which means no one will get cited, which means it was no ones fault. each driver is responsible for calling their respective ins. companies and reporting the accident. more than likely, each driver will be responsible for the damage on their car.
