There may be different laws in your state, something that I'm not aware of, but federal laws are supposed to protect your rights of freedom on your own property. They may come into your back yard, even into your house, for instance, to search for a suspected criminal they're in pursuit of, for example. If something illegal in your home or about you catches their attention and they feel it is serious enough for their time, they may return with a warrant to search/seize etc. However, there is "Probable Cause" which is, in some areas, overrated or abused, and may be easier for some police departments to justify than others. How marijuana use is generally viewed by your community will be a strong factor in determining how much tolerance there will be for an innocent citizen enjoying a blunt on the privacy of his own property.

Maybe. It really depends on the circumstances and why they are there. If they are chasing somebody, for example, and they see (and smell) you smoking marijuana, they have probable cause to arrest you, because the illegal substance is in the open for them to see (and smell). If they just smell the smoke and walk around the house, they may have to obtain a warrant before they can come into the porch area. Generally speaking, they will probably be able to come up with a warrant or probable cause to arrest you no matter why they are there.

if the police have a valid reason to be in your back yard, say call of a robbery next door, on a call of dv next door or a call about your place and while investigating they come around back smell pot see you smoking if they have a valid reason to be in your yard and in plain sight they see you smoking pot your nabbed
old law professor used to give this example police are chasing a suspect he runs into your house they follow him upon chasing him into your house they find you smoking pot your arrested

marijuana is illegal no matter how you get caught. the idiots next door to me are running drugs... I've SEEN one of them rolling a joint for someone else, the only thing is, the guy knew that I saw him, so if I call the police then, after the police leave, I'm getting a cap busted in my butt... we are having to find a way to drop a line so these idiots will get busted and hauled off to jail. As is, they've had 10,000 loud, disruptive arguments... they've blocked traffic on our street from their arguments... I hate it.

Yeah, if they wanted to. It's rare that they would where I live, but if you are in a small town, they are sticklers, or they are after you, then they might.
MJ is illegal, plain and simple. Plus, it's not healthy. It builds up in your system and takes months to purge after you quit. It can increase your chances of various cancers and reproductive illnesses. Best to just quit while you are a head. (pun intended)

Yes, marijuana is illegal. they can come into your yard is they smell it, if they think something illegal is going on, or on a tip from someone.
Don't smoke pot! They have the right to come onto your property at anytime.(all they need is suspicion)

You just gave them the right to enter your home. It is an illegal drug...maybe they smelled it from the street? You will face some trouble no matter where you get caught with pot.
