I was coming off one highway on to another that circled the city and was catching up to traffic and ended up going 75 cruising with traffic and before I knew it a cop was up ahead and decided to pull me over. My first reaction was "why would he pull me over when i'm going with traffic" and secondly "I thought the speed limit was 70 on highways in Nashville" Being new I really didn't know what the deal was, and he said that I was going 75 in a 55. I'm like "WOAH i can't believe it was 55." Later that night I went back through there and saw that there wasn't one sign between the highway I came from (I-65) and the highway I was going onto (I-440) untill well up ahead from where he pulled me over.

I wonder if I go to court and prove that there wasn't any speed limit sign that I could see before he pulled me over if the case would be dismissed. What do you all think?? thanks for any help!

I think you have a valid argument. I would add to it that you were obeying the last speed limit sign that you saw. This will show the Judge that you weren't trying to break the law.

Also, there is always a good chance that the cop will not show up at the hearing, in which case the charge is dismissed.

You should video tape from the point you last saw a speed limit sign to where you were pulled over. You'll probably

A) Realize there WAS a posted sign stating 55 or

b) By video taping, you can show there WAS no 55 posted speed limit.

The "cruising with traffic" will get you NO WHERE. Don't even mention it. The judge has heard that 15 million times. the missing sign may get you some reduction or dismissal. Good luck!

if you can prove it...with pictures and go to court that probably will wave it...but he did get you for going seventy five which is over an of the posted speed limits...just tell the judge what happened and he will probably dismiss the case

Sometimes it's just your turn. Shhhh it happens!
The judge will tell you that ignorance of the law is no excuse. However, a good lawyer might be able to get you off. But that might cost you more than just paying the ticket.

This sounds like a worthy cause to go to court for. Take some pictures before they screw you by placing one there later.

Good luck, buddy.
