Also it's not a whim, I've been working on it for a while now, but your exatly right if it was just a whim it would be a big waste of time, effort and $$$$.

The first thing you should do before you spend a lot of money is to make a trip to Washington to search the public records for anything remotely similar. In the Washington, D.C. area, the USPTO provides public access to collections of patents, trademarks, and other documents at its Search Facilities located in Alexandria, Virginia. These facilities are open weekdays (except holidays) from 8:00 a.m. to 8:00 p.m. They can also help you with a search strategy.

I've done this and you will find the search instructive and useful. It is the least expensive way to start.

If you are not sure what is new in your field you have to look through magazines or journals in your field to see if your invention is so obvious that anyone could have made it if they knew all the stuff people have already done - no patent if that answer is yes.

You need to look through on-line patent descriptions to see if anyone else has patented what you have in mind - no patent if that answer is yes.

You need to spring for some big bucks (thousands typically) to have a patent attorney do an official search and write up the patent application - if the idea is a whim and not a money maker you might want to quit before you take that step.

You normally use a patent agent or patent attorney to file a patent, because the application is a bit complex, with drawings required.

For help in bringing a patent to market, I'd go to the Small Business Administration (if in the USA) for advice.
