There are specific rules on who can take the the child dependancy deduction. It can be allocated by agreement. In fact the IRS has a form to do so. If the child's mother doesn't have enough income to pay taxes there is no reason for her to claim the deduction. Talk to an accountant and your ex to resolve this.

Sorry Mouf but that's the way the ball bounces. That's one of the drawbacks of having a child out of wedlock which I did myself with my first daughter. The difference is that I have always worked unlike your child's mother. Yes, you should pay child support regardless of if you can claim your child on your taxes. It's your responsibility. You knew what kind of girl you were sleeping with when you produced a child with her. Too bad we can't turn back the hands of time and be more selective about the most important areas in our life, isn't it...

Wow, I've heard of women like this. It's the new scam. Don't marry the bum, just get his child support payments. Women of that ilk call it "Insurance". I would talk to legal aid and see what can be done in your case. Are you getting more money because you have a dependent?

If the mother doesn't work, claim her anyway. If your daughter's social security number isn't showing up twice - power to ya! Or, you could get the mother to sign the IRS form giving you the deduction for the year she is not working.

go to court. Claim your child. but since you are off in Iraq, its hard to take care of your child. In order to claim your child, they have to live with you. You have to pay for all their expenses including housing.

I say take your kid and make her pay child support....if that's possible. I hate lazy women....living off of their children....slobs.
