I was injured on the job this year, actually in June, I ruptured a disk in my lumbar region while lifting a 28' ladder at work. My question is, has anyone else here had to deal with workers comp? If so did you receive a settlement for your injury? I retained a WC attorney on the advice of another attorney to make sure I was taken care of and they have done a great job so far. I was just curious if a settlement is a reasonable expectation for this type of injury. My doc said that he doesn't recommend me going back to my regular job based on the condition of my spine, I have degenerative disk disease, I'm 44. Thanks in advance!

Well, I've never had a back injury in my life, never been on workers comp either! I am 44 and have been fit my entire life. My doc lives right up the street from me I know him well, he recommended that I not return to the same position.

Glad that you described your nature of injury, as well as the body part & that you indicated the herniated disc. Judging from what I see here, it appears that you would be compensated under the PPD (Permanent Partial Disability) provisions of your state jurisdiction. However, HOW MUCH you receive may be affected by any of the following factors:
1 - Whether you had prior permanent disabiity in the same area. IF SO, then they are likely going to "apportion" the prior disability and subtract that from your current PPD benefits. Example, say you had 5% prior permanent injury, and now you have 10%. They would subtract the prior 5% from your current 10%which would give you 5%.
2 - HOW much PPD the Rating Physician provides in the medical report.
3 - What percentage your Attorney is legally entitled to receive.

You did good in getting legal assistance. Don't let your employer push you into a settlement right away. Go for the long term care and rehab in your settlement, not just a cash reward. In California,if you can't go back to your regular job, the employer has to pay for your training in another field. You may have an opportunity to get training of your choice where you are too. Also, don't forget, if your're disabled and unable to work, state and federal benefits may be available. Good luck.

Yes you will be compensated, even thought that will not return your health. Just remember that when your attorney asks you to settle read what you are signing and make sure that you do not give up your future medical.

Future medical is very important... that means that if you settle with no future medical you will have to pay any medical expenses on your own in the future.

Epidurals and pain management help witht he pain but this relief is all temporary. DONT EVER sell your future medical because they will offer you 15-25 thousand to sell it. It sounds good in hte begining but just an eoidural its self rums about
1500.00 for the doctors services and the out patient surgery center will come up with about another 1500.00 so be very careful. You can always email me if I can help with any questions at frontofficema@yahoo.com
