No they cannot be charged with a hate crime if there was no crime commited. Unless they are beating someone or causing physical damage to something, they can be ignored. Use common sense.

I have many friends. Some are Democrats, some Republicans, some Independents. I work with war vets, most are either Democrats or Republicans.
I will tell you right now that the more conservative people I know are many times more likely to make fun of gays than the more liberal.

No. Speech isn't a crime. If they shout the same things while they beat up a gay person or a mentally challenged individual, then yes, they could be charged with a hate crime.
That said, I don't believe you any further than I could throw you.

It's great to make fun of them. It's wrong to oppress them. Give them their rights and then rip them for it ruthlessly. I'd much rather be allowed to do something and ridiculed than to be denied my right. Once I'm denied my right I look like a criminal when I do it and the taunting is no longer in good clean fun.
How 'bout that survivor race tribe thing? I might actually watch that. I say go asians because they've got to be the underdog.

I myself find intolerance abhorrent as I am sure you do as well.
