My sons father has been in and out of jail since before he was born. I moved out of state when my son was 3 and there was no contact from his father. In 2003 he took me to court for visitation but he was going to prison and the judge gave him no visits. He got out of prison on April 14 of this year and has not tried to make contact. While he was in prison my son was visiting the grandmother every other sunday which stopped when her son got out of jail. Neither one of them have tried calling my son and they have my phone number it hasn't changed. I want to know if this is considered abandonment and if I can take him to court and have his parental rights taken away. My husband of 11 years has raised my son like his own and my son considers him his father and wants him to adopt him.

You'll have to petition for removal of parental rights. I'd suggest a good junk-yard-dog type of family law attorney to handle this for you. Worked for me in TX many years ago when I adopted my first wife's son.

Ideally you want the father to sign away his rights voluntarily. That will avoid a lot of expense and the hassle of a court case which frankly could go either way.
