A complaint needs to be drafted in such a way that will ensure both the best possible chance of winning and the best possibility of recovery of damages. This takes time.

After the complaint is filed, the defendant files an answer. Again, the attorneys are looking to case their client in the best possible light.

From there, the case enters the discovery phase. Evidence is collected. Witnesses are deposed. Witnesses are cross-examined. Documents are demanded and produced. Experts are lined up and consulted. This takes a lot of time.

From there, as each side learns about the other's case, settlement offers will be made. Some negotiations will occur. Each side has to evaluate whether it stands to lose or gain more by going to court. If both sides decide that their best shot at a favorable outcome is in court, the case proceeds to litigation.

Once it reaches court, the case will be heard with some regularity until each side has presented all of its evidence. Trial courts tend to be booked solid for months to years, so you might have to wait that long just to get a court date. From there, the litigation process can take months.

Once a decision is handed down by either judge or jury, depending on the nature of the case, is is likely that someone will appeal. This takes about as much time as the actual trial did, if not longer.

Concluding a case as significant as wrongful death in less than 2 years is extremely unlikely.

If you wrap one up in only 2 years you're doing extremely well. Some have taken decades!

But there's no such thing as an open and shut case once the lawyers get involved. The defendant is trying to limit their liability exposure and the lawyers are bleeding everyone for billable hours.

So how much money are you getting? Glad you are still in mourning and not worrying about getting paid.
