My ex husband only paid me one week of child support in the last year, and he owes me about 4000 dollars in back child support. I have sole custody of my son and I was wondering do I have to let him visit my son if he has not paid me? I actually don't want him to see him at all because he is such a dead beat. Is that possible>?

I do have a court order, I actually have 2 one from wisconsin and one from louisiana

Unfortunately no. However; you can go back to court and get supervised visits, which woul;d be a pain for him. Also contact the local DA and see about attaching his wages, tax returns etc. in an effort to collect the back support.

First of all, file for Child Support Enforcement with the local branch of your state's unit. Look in the phone book, find the address, go there, get the paperwork and fill it out -- bring your record of payments with you.

This will be a start -- when they are that far behind -- there is a concerted effort to not only find him (and you will be surprised -- they will usually pursue him for free -- you just have to invest a bit of your time and all the information you have at your hands) to get him, and then they will do the Modifications for you as well.

IF you truly have sole custody -- and your orders specify whether he has supervised/monitored visitation or any other conditions, you can legally use that for compliance. you can't totally deny visitation (unless your order specifies that -- and it MUST be specified), because if you do -- and he decides to pursue you through the courts (out of spite -- and yes, these deadbeats pull this stunt in a direct effort to obfuscate (hide) their non-payment of child support and non-compliance with the divorce decree), then you could experience a lot of hellish accusations.

So GO get the Enforcement Action started - - and be BRUTALLY HONEST with these individuals about the situation. Make sure you have the records to BACK UP what you claim -- and you will need to provide all the information you know about the deadbeat.

In my state, a father does not have to pay child support in order to receive visitation rights. If you want him to pay his child support, take him back to court and they'll get him to pay or he'll sit in jail. But regardless of that, even if you showed the court that he's an unfit father, he'd still get visitation, it'd just be supervised. So in other words, you're stuck with him. And unfortunately if you deny him his visitation rights, you'll be the one in trouble with the courts. So just find a way to deal with it because until your son is 18, it's out of your hands. Paying Child support, is a law, he has to do this. If he doesnt pay, you can keep him from seeing the child. New laws around the country will force him to pay. Now, when some parent is that far behind, then its up to you to put the wheels in motion. They can take his drivers license, business license, gun permits, put levies on his property, and all this. Paying child support is a seriou matter these days for sure, but, you have to start the ball rolling. If he doesnt follow the court order, then not only will all those things happent to him, but theres always jail! These judges today, dont play all this missing the payment, he will go to jail. He can be put on a list that people can see, its a deadbeat dad list, with his picture and all, any kind of embarassment you can cause, will do the job. However, again, YOU HAVE TO START THE BALL ROLLING, the states will not do this for you, its up to you. Anyway, if he does go to jail, what difference will it make, your not getting money now, and you arer helping yourself with out him, so send his *** to the county. Good luck.

If he does not have visition rights from the court then no.How old is your son?I have a dead beat ex too-he owes me 20,000!But, he has visition rights.One time I did not let him see my son because of his baseball game-he would never take him-and I ended up getting in trouble with the judge!When my son got older he actually moved in wih his dad.That lasted 5 months-barely.Now he sees what his dad is all about and is not curious anymore.Good luck!

I'm sorry to say that the child support order and visitation order are 2 completely seperate court ourders. So, he does the right to get them even thou he's not paying the child support.
You need to contact your local support enforcement division to get something done about it.

I just went through this and legally no just not paying child support is not enough to stop your ex husband from seeing the kids. However if you could take him back to court you might be able to stop him but legally you can just stop him.

IT there a court order? If there is non-payment is not an excuse. Realize, he;s still the kids father. Let them decide if they want to see him or someday they will hold it against you. ..and...what dont you go after the support..you owe it to the kids.

Yes you can deny him. If he isn't paying child support then i don't think he should be able to see the child. Plus it is your decision if he sees your child or not.

You shouldn't deny him the right to see his child just because he's not paying you. He doesn't have to pay you to see his child. He helped make him you know.
