Actually, this is on the books as law. If a person has been told that they have contracted HIV and fails to alert partners of their risks then by U.S. Law he/she has commit ed a felony. The felony is either a 1st or 2nd degree , attempted murder unless that person contracts it at which point it is no longer attempted.

This is the controversial situation between anonymous vs. confidential HIV screenings. In anonymous, there is a record a person (with out identifying information) has been tested and given the results. While confidential means information about that person (ssn, name, DoB, Address) has been taken and if test come back positive for HIV they enter a database control ed by the CDC.

Confidential means a person now has both an awareness of their state and a legal record of their condition, this can be used as evidence in a case of this nature.

Anonymous may only be done at state/county level under right to privacy acts. Doctor offices will put in only for confidential.

Most states have laws requiring those who have been notified that they are HIV positive to tell anyone they may share a needle with or have sexual intercourse with that they are HIV positive. Penalties for violating that law almost always involve jail time.
