n New York state how do you relinquish guardianship of a 9 year old niece who is behaviorly deranged. She is beyond our help. She has been in our home for 3 years.

Assuming you have not adopted the child and thus are only foster-parents or guardians (legal or not) you need to apply to Family Court. Best to work with a social services agency or charity that will take over responsibility. A religious-based charity might be suitable.

Children who have been displaced often act out as a way of hiding their true emotional state. Moving the chid to another household may cause feelings of abandonment and should only be considered if she posing a significant danger to members of the household.

Assuming that she is a foster child, you should contact the case manager assigned by the Department of Families and Children or their counterpart in New York State. Other options include:

Individual counseling: When choosing a counselor (whether PhD, MD, or MSW) make sure you find a person that makes a connection with the child, and the child feels they can confide in.

Family counseling: While individual counseling may assist the child in finding herself, it is necessary for the entire family to understand the complete situation and have "everything on the table" so to speak.

My personal recommendation is to seek a Social Worker as the therapist, in that the feild of social work looks not only at the personal side of adaption, but also the external (familial) factors.

There is no such term as "behavioraly deranged" in psychology. Is she under the care of a counselor? If not, you owe it to her to get her help, she is a minor and dependant on you to help her. A child isn't something like a fish you throw back if you don't want it. If you relinquish your guardinship, she will spend her life in foster care until she is 18. Not what I call a nice life. Get her the best help possible and save a life. She may thank you some day.

Why do you want to relinquish guardianship? You just want to throw her away? You can probably get her into a home without doing that.

She is a child that you have had for one third of her life. Accept your responsibility and help her. On the other hand, she may be better off with someone who gives a damn.

have her talk to a dr. about why she is acting out and let the dr. help you at home.
