I'm not sure what the laws in Texas are, but I'm pretty sure that you can get legal aid for the divorce and he can't contest it b/c he's been convicted of DV against you. In most cases like this, you should be able to get some help from a women's advocate or program in the area for abused women. Good luck and stick to your guns.

Contact legal aid first of all and see if they can help you. If not you should be able to use a kit and type up some pretty simple papers yourself since you have no children or assets to divide then you can file for a paupers affidavit and have the filing fees waived.

More than likely you will have to pay for it. However, court appearances and lawyers may not cost as much as they normally would cosidering he is in prison. Some states have different laws w/ divorce given one party is locked up.

You really need to consult with a lawyer who can answer all of these questions. Certainly you do not expect professional, knowledgeable responses from this site!! Some attorneys offer free consults and charge you only if you hire them to take the case. Check it out.

Chow!!

Should be cheap.
No children, no assets, and he really can't fight it, being in prison for abuse.
Call a lawyer. A consultation is free and you will know the fees.

you can file your paperwork your self. i think there are "kits" available on line to download for a small fee. i think uslegalforms.com has them. the forms are $45. go to both sites:
http://www.uslegalforms.com/divorce/texas-divorce-forms.htm

http://www.uslegalforms.com/divorce/texas-divorce-forms.htm#faq

you dont need an attorney either. court fees are minimal, but may be able to get them waived also. good luck. email me if you have anymore questions mml619@yahoo.com i represented myself in my divorce.

There are special places that could do this for free one this is the volunteers Lawyer project. But if there is nothing to fight over go to a court in your area and ask them for divorce papers fill them out and then go to drop them off it will take no time if there is nothing to fight over and he is in jail.......LOL...... Hopefully he'll die in there.....I know what your going through my mother is too ........Good Luck.......You'll win..........
