Depends on the laws in your state, ask your lawyer.

depends on how long you were married and what kind of divorce you are getting. Your lawyer would be able to tell you. I think if yall have been married a while the business owner buys you out. Either way it is something that your lawyer will handle and tell you. I mean that is if you have been married like 10+ years. If it was only a couple of years then come on dude. Different states have different laws. Here in the Ga if over 10 years your spouse is declared part owner and you have to buy them out. My brother had do it. She had no part in his business and she got a hefty check for 4 years.

In the divorce you should ask for 1/2 ownership of the business, 1/2 of any wages she should recieve from the business. If this business was started while you were married to her you are entitled to half. Everything is 50/50

there is a lot more to it then that. You need to prove that you contributed to her, the business and the financial gain as well as show you sacrificed your own financial stability for hers. Consider having her buy you out of it instead of ruining her business. Get a lawyer.
