I was a lane away and a few car lengths behind him - it was a big 18-wheeler "pickup" style truck that was hauling stones. One hit my windhshield and not only chipped it, but it splintered it out into a star-shaped crack surrounding the chip. I was able to get the name of the trucking company and their location and this AM hunted them down and found them online. What do you think my chances are of having them pay for it? I'm assuming slim-to-none but i know that stone came from that truck - he got off at the next exit and i was unable to get any other info off the truck. I assume when i call the company and tell them what happened i'll get "we had no truck there this am". Is it even worth the bother?

Thanks gang! I appreciate it. I just didn't know what to do - after moving to Mississippi i lost my old insurance co that i had for 15 years that i only used ONCE! Now, i've had Progressive for not even a month and i have a claim to file - just apprehensive about it - i called them and they said the fix it for free, but i still gave them the trucking companies info. Not a good way to start a happy Friday AM!

It is worth a try. The trucking company is liable. You may get resistance from the trucking company. If you have auto comprehensive insurance, submit a claim to your insurance company and let them chase after the trucking company.
If the damage is repairable, and if you have comprehensive insurance, your ins. co. will pay to have it repaired and waive the deductible.
Last resort: Sue the trucking company in small claims court. They may feel it is not worth the expense to answer the complaint and may just pay up.

Call your insurance company and explain to them what happened.
If the other company should be liable, your insurance company will go after them for the cost of the windshield. If not, then your policy should cover it.
You pay insurance premiums so you don't have to deal with this type of frustration, make your ins co do their job.

The trucking company would be liable is the stone came from their load, but not if it was on the road and thrown by the tire. You would have to prove that the stone came from the truck, and that is almost impossible to do.

Actually in Wisconsin they would cover it. Just as long as it came from there load. Many of my friends are pulp truck & dump truck drivers. If the stone comes from their wheel it is a act of God. If it falls from their load they are responsible.
But if you don't have the info from the truck like it's license, name of company your pretty much screwed.

If you have full coverage insurance, it will be covered without raising your rates. next time get the license number of the truck. They are supppose to clean their trucks from loose stones on the sides after loading. If it was kicked up... you would be screwed but the insurance would still cover it.

if you have the companies info from the truck,,,,yes they are liable (to an extent ),,,,however,,,I'm not sure about all states,,(worth checkin into ) but in Florida,,your insurance company,,( reguardless of your type of policy),,,will replace any and all broken windshields for free,,without affecting your rates,,,No claim involved,,,,,,,its a new state (maybe Federal ) policy they've come up with

Just bite the bullet & get it repaired on your own windscreen insurance it will be quicker & easier it was an accident! That's it that's life. No it's not worth the bother be positive and get it sorted now!

If you live in Wisconsin, you have no chance. Check the local laws and ordnance's before going to the trucking company.

in NJ yes they are, but its almost not worth going to court - it's basically your word against a big company... unless u have absolute proof. which u don't - so buy a kit and if its just one of those little pebble looking breaks - u can fix it so it doesn't

I don't think they would be liable because loose cargo such as stones is expected to fall out, covered or not. It was a freak accident. I don't think it's worth your time.
