My cousin married an American and for some reason he found himself back to Ghana and cannot secure a visa to go back. He has lost contact with his wife who is still in the USA. Can he legally dissolve the marriage in Ghana?

Yes he can get a Ghanaian divorce. Unless the American spouse accepts the jurisdiction of the court and an American court in the future accepts (1) that the Ghanaian spouse was legally domiciled in Ghana and (2) the American spouse had adequate notice, the divorce might not be recognized in America. But if you take care, this is unlikely.

However, the American spouse might countersue in America. How this would be resolved by the two courts is hard to predict, although the acction brought first is supposed to have priority, by "comity".

The Embassy consular section is supposed to grant a visa for the purpose of appearing in a trial in the United States. They are supposed to waive such things as prior convictions for that purpose. If they suspect fraud, they might resist granting the visa; a letter from the Court and explanation from the US lawyer might change their mind.

No idea about American law, but I was able to get a divorce in England from a marriage made in another country (or hell, depending how you look at it)
