In most states, the judge will still want to child to go with the mother. You need pictures of the sex act, if possible. The judge can't say it was your fault for her running around, if there are sex pics.

First, get a lawyer. Keep records of EVERYTHING! You will need that in court. Get pictures, if possible of any negative thing you can. Be prepared for a long costly battle. It's not going to be fun for anyone involved, especially the child. Try not to involve him at all. He'll feel pulled between his parents and no matter what a low life his mother is, it's still his mother and he loves her. Do not use the child in any way. He will hate you both for it. Good luck. My son went though it and it's NOT fun. By the way, he did win custody.

Get a lawyer and ask yourself, not what is fair to you, but what is best for your child. What your wife did to you was not nice but where would your child be happiest, bettter taken care, under what conditions would he thrive? And then try to provide that situation for him, whatever that may be. Even spend a few dollars on consulting a child therapist and if he is 8 year old, try asking him what he would like---but let him know that you will not be mad if he says he wants to live with mom because you will always love him no matter what. Raising a healthy well adjusted son is all that should matter. (PS If your son wants to live with you, congrats but if he wnat sto live with mom and she doesnt have a job now, then isnt child support supposed to provide for your son?)

file before she does and ask for temporary custody till the divorce is final them get your facts together in how you can be a better parent and provider and where will the child have stability your problem is you're in the military and its subject to transfer you at moment notice it not matter of who cheated but where will the child have a more stable life, or prove that she is unfit mother hard to do this days

Get a good lawyer! The fact that she does not have a job will not matter, the court will simply grant her spousal and child support. You also need to find out if you live in a "no fault" state, if you do then the circumstance to why your wife left will be irrealavent.

hello. the same thing happened to my parents. after signing the divorce papers, there was a whole tug-of -war thing going on within the whole family and it was really bad and traumatizing. i think you should be able to get you son because your wife commited adultery. but if you go on buisness trips alot, you might lose. because my dad flies alot. and thats why he lost my custody. so, if you dont fly alot, you should have a pretty good chance. i guess you should talk to you son. but you should not force him. its really bad. yeap. hope that helped. and good luck.

the only thing i can suggest is just explain that you wish to have gardianship or sole custody over her becasue you have a secure income and you are able to provide for the kids and she is unemployed and you fear she is unable to provide the proper elements into your son having a secure and safe enviroment

damn! had the samething happen to me and it 2 lawyers and $7,500 later to settle it out or if you have a good enough lawyer then keep taking her back to court and drown her with money from the court costs! get a damn good P.I(private. investigator)-- good luck! ! ! ! there r alot more guys getting there kids so keep your head up and there is hope ! ! !*********oh and by law you have **only** 1yr. to file if she cheated on you and she can't move back in you b/c then that looks bad on your part...EVEN IF YOU HAPPEN TO LEAVE with your son w/out her permission u can't get in trouble by law(I did that) and file 1st and get temp. custody! ! ! ! ! with a stable place of living with the intentions of a ''BETTER WAY OF LIFE'' for you and ur son ! ! !

Documentation, photos, wittnesses, etc. Hire a private detective, hire a lawyer, and make sure she doesn't know that you know. A judge will see all of this evidence as favorable for your custody.
