Murder. If they make an attempt to kill you, and in that same moment you kill them, it's self defense. In actaullity, results may vary, and the ultimate decision(other than God's) is the judge who will find you guilty of murder, or only a murder in self defense.
Either way your killing someone though, so I'd just let the guy shoot me, however, following my advice may result in being killed. =)

Most states define self defense for use of Lethal force as "using lethal force in a situation where a reasonable person would believe that his life is in danger, and a reasonable person would believe that using lethal force is the only way to defend himself. "[1]
So in the situation you described -- it would depend on how serious the threat looked, on did you have a reasonable chance to run away, could you reasonably incapacitate a person with a non lethal attack, etc etc...

Murder or Self-defense is too subjective since it is sub-judice !
Very difficult to decide even otherwise, since it is situation dependent !
Suppose we can defend ourself, why commit murder. And how to decide whether we could have defended ourselves, beforehand ? In such situations, the accuracy of judgment is to be decided by results alone !

Legally its self defense after they attempt to kill you. If they don't attempt to kill you, and you kill them, then its murder.

Aren't ethics fun? IF you can prove they would have killed you, it is self-defense, otehrwise it is murder. Basically, it depends on how competent your lawyer is...always does.
