I told this woman I didn't want to be "friends" with her anymore and I look on my 360 and for some reason thought to look at her photo album and she has pics of my children on them. She is definately not taking this well but I never thought she would victimize children over it. Her daughter was friends with mine and she took pics at their school and posted them for all to see.

well if it was a picture of her kid and her kids friend (your child) I think youre over-reacting a bit .If it was a picture of just your child it would be a different story why would you want to press criminal charges for that? is your childs name , address , school on there? if not I think you are just angry toward this woman for whatever reason and making a big deal out of nothing

You can try the claim that images of your children have market value to which you have a priori rights. You might be able to charge her a fee for the use of your children's images for her own purposes. The reason I know this is because the mom of the "Prussian Blue" girls is collecting fees from people who use her twin daughters' pictures on the Web.

OH MY GOD.
The pictures of your children are on line!
What a tragedy! What is somebody will see? How will they ever lead a normal life again?
The people should not be able to post the pictures they took willy-nilly!
I say that the perpetrator should get the death penalty -- it exists for a reason!

Call the police if you're concerned...make sure you have proof. Take a screen shot of the album. Your keyboard has a "prnt scrn" key (or something to that effect) that automatically copies anything that you can see on the screen...you can then paste it into Paint...be sure to save.

If you want to get really technical, I think you might be able to because people are supposed to get the permission of a minor's parents in order to use their photo, but I'm not sure that it applies in this case.

The police would probably just write it off as a petty argument, seeing as no oen was being defamed or harmed. They have more dangerous "criminals" to deal with.

Not unless it's libel. Has this hurt your reputation in any way? If not, then forget about it.

Create your own website and post pictures of her kids.
