Ok I will post in sequence order of events...

1) Struggling good friend finally got job, didn't wanna put $400+ down for a cell phone because of no credit, so I got it in my name. (yeah, I know, mistake #1)

2) One night we are hanging out, I ask him to drive home, he hits a deer, I only have state (MS) minimum required (liability) insurance, no police report was filed, he offered to pay $500, $100 a week for five weeks until, I didn't agree or disagree because I knew the damages were gonna be well over that. So I kept quiet.

3) I finished the drive home, he was very apologetic that night. Didn't hear from him in a while after that night, figured he would contact me in a few weeks because his phone bill was due, that didn't happen.

4) I have proof he caused the car wreck by a recorded conversation, he has no proof he ever gave me any money for the phone bill for months ;-)

Small claims in MS max only $2,500. Need next better option because I'm looking at well over $3,500

first..turn off the cell phone!! that will get his attention....then send him some kind of correspondence, via phone or your choice, and tell him he has x amount of time to start making good or you will have no choice but file a claim in small claims court....whatever you do, document all correspondence and any payment he does start to give you...plus you must, must follow through with going to court after the time limit or he'll just continue what he's doing!!...good luck

And you still call this person a friend? Go to small claims and get the $2,500 even though it doesn't cover the entire amount owed to you. This guy has no plans to pay you anything and will beat you out of all of it if you don't do something.

This don't sound much like a friend more like a fiend, first get their attention by having the phone cut off and if they don't respond to this subtle hint send them a legal notice of your intention to take them to court, and remind them what will happen to their credit record if they get a black mark. If all else fails count your losses and open a web page on them complete with photo address, place of work etc.. that might their attention!! Good luck and pick better friends

You need to make better choices in who you call a friend.
Not sure of law, but could you sue in civil court over this matter?

I think it's time to cut your losses with this person. Salvage what you can and move on. They are obviously taking advantage of your hospitality.

this is not a friend....cut them off....get heavy.

you need to take your friend to court to get your money and fixes your credit.
