If you were harmed due to someone else's negligence and if you have suffered damages and if you have contacted the other party and they are unwilling to compensate you, get a lawyer, that is when it is justifiable.

only under absolute negligence and if they are uninsured.
Drunk driver for example is negligent, but insurance covers him if you sue. If he is ununsured, I defenitely sue.
Mal Practice, there would have to be an obcious case of negligence for me to sue.
