Yes, it is against the law if filed with the divorce papers and seek alimony from it.
You won't go to jail or prison type of legal issue. It is mostly about settlement/money.

It is possible that there is a law. There are many antiquated laws on the books in many states and cities. It is still on the books in some California cities that it is illegal to have sex in a motel, even if it is your spouse. Many states also have laws against sodomy.
To find out if adultery is illegal in California, it would take some one with time to do a little bit of researching.
If it is against the law in California, it should be repealed.

No it is not against the law. Its against moral values. A person who gets married should be faithful if they are not happy and want someone else leave before you have the affair. It is not fair to the spouse.

Yes it is - but it is only really used in divorce settlement cases, because California is a community property state and that's one of the few ways you can get more than 50% of the combined assets.

I assure you, even if it is, it is NEVER enforced. Half of the police force would have to be jailed! IANAL, but I suspect that it can be used as evidence of wrong-doing in a divorce case in any state that allows other than "no fault" divorces.
