Unemployment benefits are funded in part by the employer after the state and the employer agree that the applicant deserves said benefits.Usually this happens when someone is laid off or terminated due to conditions that aren't the fault of the former employee.
Why should the employer agree to pay a dishonest employee after they have stolen from the company ? The former employee has already benefited from ill gotten funds that came from the company! The company is just getting screwed again! Not to mention the tax-payers dollars that fund the unemployment office's workers!
The employer should tell the unemployment office EVERYTHING!
This person should not get another dime that they haven't honestly worked for! They should also be prosecuted!

The way that unemployment works is that if a worker is laid off or let go, they have money coming in so they don't lose everything while they search for another job.
If an employee is fired, the employer has the right to contest any unemployment compensation that would be given to that employee. This is done through a phone conversation or a personal "hearing". Most of the time, employers find that it is not worth the time or hassle to "fight" the application of unemployment compensation. But if it were due to theft that I had fired an employee, I would not hesitate to fight that one. Whatever it took.
She will not get unemployment compensation for losing her job for breaking the law. I would hope the company would not allow it to happen.

On the unemployment form is a question of why the employee was dismissed...dishonesty is a prime reason. If she stole the money, she can be prosecuted and should be. For, she will go to another employer and do the same thing.

I think it is the employers responsibility to report the reason for termination and let the unemployment office discern whether or not the secretary is eligible.

The TRUTH is always the legal answer.
Besides....why would he want to lie for someone who stole from him???? That makes no sense whatsoever. She already has the money she stole....so now he wants her to get unemployment too???
If he likes this woman so much, why did he press charges???

Unless he reported it to the police he can't say that was why she was fired her without the proof of a police report. I know that is how it is in Oklahoma. If he filed against her for it through the law then he can stop her from getting it.

Hi,, i use to work security for several large chain stores... and what we did ,, if we caught someone in the cash.... was to fire them and not prosecute for the money, but they did not get any unemployment compensation... if they wanted to fight it,, we had the evidence of embezzelment and would fight fire with fire...
