Hi I recently was working as a delivery assistant ...deliverying washing machines, fridges, plasma tvs etc.. from 17th April 2006 until August 7th 2006 basically I was offered another job and was going to hand my notice in on the 7th but as I'd injured my back watersking on the 6th i wasn't fit to go in to work as it required heavy lifting. I therefore told them this and said i won't be able to come in today as i've injured my back and probably won't be fit for the week! I them gave them my notice over the phone and send a letter in writing. the week after this 14th - 18th august was meant to be my holiday. please help me out.......if i am entitled to it what do i do because they haven't paid me it! cheers :o)

Depends upon company policy. Some pay you for acrued holiday pay when you leave and some don't.

The Fair Labor Standards Act does not require payment for time not worked, such as vacations, sick leave or holidays (Federal or otherwise). These benefits are matters of agreement between an employer and an employee (or the employee's representative).

How is severance calculated and when is it due?

The FLSA requires payment of at least the minimum wage for all hours worked in a workweek and time and one-half an employee's regular rate for time worked over 40 hours in a workweek. There is no requirement in the FLSA for severance pay. Severance pay is a matter of agreement between an employer and an employee (or the employee's representative).

The Pension and Welfare Benefits Administration (PWBA) may be able to assist an employee who did not receive severance pay required in his or her employment contract.

You need to go to the department of workforce services they will help you file a claim if you aren't getting what you are owed ask anyone there they will point you in the right direction.
