Hi I recently was working as a delivery assistant ...deliverying washing machines, fridges, plasma tvs etc.. from 17th April 2006 until August 7th 2006 basically I was offered another job and was going to hand my notice in on the 7th but as I'd injured my back watersking on the 6th i wasn't fit to go in to work as it required heavy lifting. I therefore told them this and said i won't be able to come in today as i've injured my back and probably won't be fit for the week! I them gave them my notice over the phone and send a letter in writing. the week after this 14th - 18th august was meant to be my holiday. please help me out.......if i am entitled to it what do i do because they haven't paid me it! cheers :o)

p.s. on the week 14th-18th I actually had my time off work booked in i dont know if this makes any difference! hope it does i need the weeks pay!

"not a perfect fool" because I had worked there for over three months and this entitles you to a weeks holiday so if I didn't have the holiday ain't I entitled to the pay?

No. Why would you be entitled to a paid holiday AFTER your job is over?

If you had unused haoliday time on the books then they have to pay you for that when you leave the company. If you acrue holiday time (also called vacation time) at your job then if you do not use it you do not lose it. It should be paid to you when you quit. Different rules apply to sich leave and a floating holiday -- usually you are not paid for those if they are unused.

They may be confused as to if and when you quit. Did you say you were quiting and your last day was Aug 18th or Aug 21st??
They may have thought your last day was before Aug 7th???

I doubt you will get it. Normally you have to be at work or have vacation time planned on the days before and after a holiday to get holiday pay. I believe an injury, especially not work related and even doctor excused, will count as sick time and not be eligible.

You could probably get it but you may need a lawyer. Could be more costly than it is worth but if priciple is what you are after then go for it. Try contacting your local labor board there and see what they say first they may presue the case for you.

screw them! you should but remember you have to read the employee manual.... If there are no restrictions as far as to employment Lent necessary for you to qualify for the special pay, otherwise you are screwed :)
