Some off-road knobby tires can get away with not being DOT approved because they aren't for use on public streets.

The Department of Transportation rating applies to all tires sold in the US and destined for use on the highway. The tires receive ratings for tread wear, load rating, and such in order to keep inferior products from being used here.
