Is is possible to sue the state of Texas or it's contractors. I.E. A intersection is set up on a highway of 55 mph BUT no signs of the up coming inersection are in place. A major accident occurs is the state liable since they were negligent in having warning/advisory signs posted. This intersection had the non working lights flashing for 2 wks on red before they set them to work..Note also that you are the victim in the accident , had a green light are insured and the other driver is insured too, the one who hits you by running the red light.

This happend to my brother in law and his girl friend. He has 7 broken ribs, colar bonce, ankle, and a recovering from a collapsed lung due to his broken ribs. She has 3 discs out of place on her back , broken tail bone, collar bone and shoulder blade..Note all inoperable and very painful. Both were wearing seat belts TG.

BTW 5 more accidents have occured in this same location since the 18th of this month, all required air life and the jaws of life to get them out of the cars.There has been 1 child death.

The attorneys are naturally correct about the law: States can generally not be sued for this sort of thing under the legal doctrine of sovereign immunity. It sounds like the other driver is the party from whom alone recovery should be sought.
