Miscarriages are not intentional. I think I see where you're going with this, though. Miscarriage is a "natural" abortion, so if society decides to outlaw abortion, then following Kant's categorical imperative, any early termination of pregnancy, natural or otherwise, would have to be punishable under the same laws. Very clever.

This is ridiculous! A woman has NO control over having a miscarriage. In fact, chemical conceptions takes about half of pregnancys so quickly that women don't even know that they pregnant in the first place.
Dispite over-population, miscarriages occur almost more frequently than births, and keep in mind, still birth, SIDs etc.
One more point, the father does almost NO work to make a baby and would NOT have to right to sue even if she had an abortion. It's her body, and her life. and unlike the father, she will not be able to run away from the process.

A miscarriage is a biological response to a natural, or unnatural occurrence to the fetus. I could be caused from both inside of the womb, or outside of the womb. IE..a woman could throw herself down a flight of stairs and cause a miscarriage, and yes in a case such as a self inflicted miscarriage, i do believe the father should have the right to try for prosecution. Although, abortion is legal in our state, I don't know about yours, so did she cause a miscarriage, or an abortion. So most of you who believe that a miscarriage cant be caused, your Wong. Mothers who smoke crack can cause a miscarriage, what about them should they be charged, . What is really wrong with America, is that they don't think things through fully before criticizing someone for there opinion.

Are you crazy?? A miscarriage is not the same thing as an abortion. A woman cannot help when a miscarriage happens and when it does not happen. Even if she were in a car wreck that was her fault, sometimes a baby will survive that and sometimes they don't. That is in the hands of God.

Whoa, don't mistake the word "miscarriage" for "murder" or "Manslaughter." UNLESS, of course, it can be proven that a woman intentionally put her fetus in harms way ie. running belly first into a brick wall. But again, that wouldn't be a miscarriage ... it would be a murder ... or would it. See, an inane question can spawn something interesting.

You are mistaken, a miscarriage is a natural occurrence not the fault of the mother. It happens to many women. For some reason the fetus does not develop normally and is expelled. There is no one to blame except nature.

you are silly and this question is very insensitive. Anyone who has gone through the agony of a miscarriage would never ask such a question. If you're trying to make an argument that it is like abortion so the same laws should apply, I think you need to read several books on logic.

I think you mean abortion, hun. One cannot control a miscarriage.
After reading your additional info, I wuld have to say yes it should be considered manslaughter. If she killed and innocent child in the back seat of the car accident then the same should apply for an innocent child in her stomach.
