My wife was hospitalized for 3 weeks then taken off work for 6 more. Her boss told her she had short term disability and said she had sent the papers in and there was nothing to worry about. We found out now that we dont have short term disability, and that we were lied to.

no because of the republicans who wrote laws to let businesses off the hook .

If you have proof that you sent in the papers and that those "papers" covered short-term disability. Then you'll need proof that the company recieved those papers that you sent in. You should have received a notice in the mail that you put with all of your insurance papers. If not, it sounds like you're SOL. Everything with insurance MUST be in writing. Verbals do not count.

Not really.

Your employer is responsible to provide you with what he is required by law. If he is required by law to provide you with short term disability then yes, he is responsible. If he is not, then it is up to you to read the information provided to you by the company.

If the company only provided verbal information, then yes they would be responsible because they are required to provide that type of information in printed form, or at least make it available to you in that format. For example they could provide it only in digital format, but you should be able to print those forms if you so chose.

Did you pay for the insurance or is it in the company handbook?
If yes, tell her you will see an attorney. If not, without proof you will probably not win in court.
