She may be a big time lawyer but she is not a big time Grandma or else she would be taking care of them. As long as your boyfriend can show he has an adequate place to live and has maintained a job you have a really good chance of winning, espescially since these are his biological children - normally they check both parents before considering other relatives,so I think they will look to him before considering grandma. Also to give you a more stable image, when you appear in court say that you are his fiancee, it looks better than a girlfriend - fiancee will suggest a more family-like home environment, show that he's serious and committed, and they may even consider your income as well which may help him - If you're not working then that's still a plus because there is someone to watch the kids while he's at work. And I'm not saying he's not serious or comitted now but in the eyes of the court it will look better. For legal representation check with your local court office I believe there is something similar to a public defender that would be available to you. If the grandma is a big time lawyer what the hell are her daughter and grandkids doing living in a homeless shelter? Why would her mom try to help her keep her kids if she won't even offer them a place to stay? That doesn't make sense.

There is only one way, and that is through the family courts and for that there is no getting around it, you need a lawyer. The judge will decide based on testimony the best environment for the children. In the meantime, don't do anything silly like try to take matters into your own hands.

If... the children are neglected and you have proof, it is a fairly easy case to win. I myself have won such a case and have full custody of my son. Cases as these are not hard to win, what prolonged our court fight was visitation.
My advise is collect all data and proof you have, if your low income seek help from legal aid in your state. In other situations, "Most" lawyers will allow you to pay out costs. ( if they feel the cases is needed for the good of the children ) If the ex wife is a druggie & partier, request at 1st hearing DNA hair shaft testing.

Call CPS. Then file a custody change order. Then file a restraining order. Don't need big bucks for those. And if the environment for the children are that bad and he is the better alternative, the state will not hesitate to grant them.

First of all you need an attorney. Secondly, it is unlikely the court will grant him custody if the 2 of you are living together not married. He needs to be able to prove that the children are being neglected. An attorney can better advise

hi,
I think that it is up to the judge anyways. and if this is all true of the mother then even an idiot would see she is unfit. I would give it a shot and just get one of those lawyers that only get paid if you win.
