This is at my condo in Brookfield, WI and the fine is a city ordinance violation. Is this ever going to stand up in court? The police gave me a $172 ticket for "prohibited noise violation" because I was talking to a friend in my garage late at night and a neighbor says she could hear it. The garage door is very thin aluminum and the cops said they could hear me from the other side of the door, but c'mon, it was only talking and it's not like a was yelling or something. I got a copy of the police report and the cops said I was talking 'very loud', which I don't think I was. They warned me a couple weeks ago for 'loud talking' but said it would be ok so long as I kept my garage door shut. I kept it shut though and they gave me the ticket anyway.

Sounds like you have a sensative neighbor. If you can talk with your neighbor to find some common ground, Great, if not better move. If you're in a condo you are responsible for respecting the other people rights to privacy & noise levels. I would think if you were warned once, that was your chance. Get new neighbors.

How far is your garage from the street?

A ticket for talking, I've heard it all now! BUT.... Your definition of talking loud may be different from the cops, too. My husband talks loud all of the time, but he is nearly deaf. Guess we would be getting a lot of tickets!

check into the ordinance and find out the specific wording of the ordinance... if it says any noise heard from the street with the doors closed is a noise violation then you're probably gonna have to pay... if it doesn't look good for you then plead no contest and tell the judge you'll keep your late night conversations inside the house from now on.... they may reduce the fine if you're appologetic and sincere... it's not like you're some nutcase dealing meth out your backdoor.

You were warned,why do you talk late,how late was it?,fight in in court ask for a dismissal,if that does not work get a trial by jury.
