murder on your part because you didn't stop or suicide?

no, only a professional ( on OR off -duty)
has a legal obligation.

No, not in general, but could be.
Murder requires some "actus reus"[1]. This means that a person to be held guilty of a crime must COMMIT some action, OR fail to do some action that he was REQUIRED to do by law.
In the aforementioned situation:
Say the patient comes to a psychiatrist and asks to be killed -- thus clearly indicating suicidal tendencies. Doctor ON PURPOSE[2] refuses treatment and walks away. Patient commits suicide.
NOW it can be murder.

It's definitely not murder. To intentionally kill somebody you have to have the intention and forethought to kill. It's a suicide for the person who killed himself. But it's not assisted suicide as you didn't help them.

It is suicide. Your conscience might bug you over it but, it is just suicide. Some folks weren't built to hold up to the world, sad but true.
