Correction: What, in the Constitution, gives the federal government the power to regulate drugs, medication and food?

I am not a Constitutional expert but I don't think anywhere. Maybe it is next to separation of church and state.

It's an extension of the Commerce Clause, in Article I Section 8:

"Congress shall have the power... to regulate commerce with foreign nations, and among the several states..." That plus the power "To make all laws which shall be necessary and proper for carrying into execution the foregoing powers".

As interpreted by the Supreme Court for the past century and a half, the phrase "necessary and proper" really means "anything related in any manner, as long as there is some tenuous connection".

So, because the cumulative effect of all drug, medication and food sales, all taken together, would have some impact on commerce nationwide, Congress can regulate all those sales.

It's one of the most counter-intuitive mind-boggling non-literal interpretations of the Constitution I've ever seen. And for some reason, the people who want judges to literally follow the text of the constitution have never gone after this huge massive gaff and tried to return the federal government to one of very limited enumerated powers.

The constitution gives congress the power to make laws and in turn, congress makes laws to regulate food and drugs. They think they know what is best for us.

It's not in the constitution, it is just a law set by the government. We would all be in a world of hurt if it were not for those laws.....at least most of the time.
