yes. it should be paid out if you didnt' use it. Vacation is not a perk, it's in the government employee standards that you are entitled a minimum vacation for x number of years worked. if you have not fufilled the min. requirement you are s.o.l.
This varies from state/province. the following is from the Alberta Employment standards
"When is vacation pay to be paid to an employee whose employment is terminated?
Where proper termination notice is given, or notice is required to be given by the employer, vacation pay must be paid within three days of termination.
Where neither the employer nor employee is required to give termination notice, vacation pay must be paid within 10 days.
If an employee quits without giving proper termination notice, the employer must pay vacation pay to the employee within 10 days after the date on which the notice would have expired if it had been given."

Usually you give two weeks notice and if you have vacation time they will just let you leave with vacation pay.

yes. If they do not pay call your State Wage and Hour Commission and file a complaint. They will force payment.

I think it really depends on where you are and where you work... state to state regulations vary greatly on many employment issues, and I would be willing to bet that this is one of those issues...
