The judicial branch of the US government was created by Article III of the Constitution. However, the Constitution did little more that bring it into existence. Congress filled in the details with the Judiciary Act of 1789; this was one of the first acts of the Federal Congress. John Jay was the first Chief Justice of the US Supreme Court. Thurgood Marshall was the first black justice. Sandra Day O'Connor was the first female justice. During the New Deal. Franklin Roosevelt tried to increase the number of justices from 9 to 15.
