I see some people need to do a bit more reading on the civil war. I am talking about the ones who link the flag to racism. Just because some ignorant kkk guys use the flag in their hate propaganda, does not mean that is what the flag represents. The confederate flag has nothing to do with racism. That is like saying anyone who wears the colors of african flag is racist, because the black panthers wear those colors.

Because they are hypocrites. They claim to be tolerant, but can't tolerate an opposing point of view. They want freedom of expression when they have something to say, but want to redefine any opposition as being "hateful" and necessary to ban. It is a way of bullying others to accept their viewpoint which is often high on emotionalism and low on facts. Since they can't debate using the true facts, they resort to namecalling and attempting to muzzle the conservatives. When you go to message boards, you see the same type of tactics described above used most of the time. I don't mind someone standing in opposition. They might even be right if their facts support their viewpoint better than my facts support my view. However, I resent the double-standard that the majority of liberals usually apply when debating. This excludes those that have valid points and present their ideas fairly and respectfully.

The South was absolutely right on their stance on states rights. The Constitution clearly reserved all rights for the state that were not expressly given to the Federal Government. The States preceded the Federal Government as 13 colonies, and then 13 states under the Articles of Confederation. The Federal Government exists due to the express will of the States, not vice versa.

NO state, North or South was willing to give up their states rights. In that respect the South had every right to secede and defend their rights. Unfortunately, they pressed the issue in regard to slavery and on that issue they were not on moral ground. Slavery needed to be ended. The North was complicit in slavery as they often provided the slave ships. They had also yielded on such issue as the 3/5ths Compromise. Most white Southerners did not own slaves. They could not afford the land or the slaves. Slaveholders were a special wealthy class, not the average Southerner. However, after the North invaded the South, most able-bodied Southerners fought under the Confederate flag, not so much to preserve slavery as to defend their land and homes from Northern invaders. Most Southerners to this day despise big government and meddling in the affairs of the little man. The idea that a man's home is his castle is a big one, and zoning codes, etc. are not well-received in most areas of the South. This is also true of the west (California excluded).

How should these activities be covered constitutionally? The amendment which would apply is the first amendment. The first amendment promises free speech; yet, some exceptions have been made. The First Amendment does not protect actions as free speech that are considered obscene. Some actions have been identified as obscene such as: hate speech, child pornography, sexual harassment, etc.

Flags are a symbol of an idea or nationality. Burning of a flag would be a strong way of stating objection to the idea or nation it represents. Many of the people that hold that idea dear would find this desicration of their symbol to be obscene.

The Confederate flag is an interesting case as the thing it symbolizes is different to different people. The people that fly the Confederate flag tend to think that it symbolizes the rich history of the South while opponents tend to think it symbolized the darker aspects of that tradition, namely slavery.

The liberals that want to protect flag burning, yet prohibit the flying of the confederate flag are not complete hypocrites as the cases should be handled differently; however, I still disagree with them. I do not think that the political message given by flag burning overcomes the obscenity of the act (there are less obscene ways of giving the intended message). As far as the Confederate flag, the way that the opponents view the flag is as one of slavery; however, slavery itself was only a small part of that tradition (the Civil War had more to do with state rights vs. federal rights than slavery). As most people understand that the flag does not actually represent slavery, it is acceptable to protect it under the First Amendment.

Because nobody burns flags anyway except the vet groups that do it in an honorable way. It's a worthless nonissue to get the hoi polloi distracted from how they are being screwed over by the upper one percent.

And waving a Confederate flag just announces to the world you're white trash. You know, Japan doesn't keep harping about the Rising Sun. Germany doesn't talk about the rise of the Fourth Reich. The UK ain't trying to bring us back into the British Empire. So why do you inbred hicks keep waving the flag of the losing side? You lost. 141 years ago. Slavery isn't coming back. Get over it.

Well, got a news flash for the liberals who don't like the rebel flag. Alot of Southerners are now flying some of the other confederate flags. The stars & bars was just one battle flag. Dumb yankees.

As for burning the Stars & Stripes? Some one setting the American Flag ablaze does not effect me at all. I am a patriot. I know where my heart belongs and where I stand. The flag-as much as I love it, is only a symbol. Burning it doesn't make me any less American, it doesn't detract from what that flag means to me, and it doesn't lessen our nation. All it does really is lessen my opinion of the fool who torched it.

I don't think ALL liberals believe in both those things you mentioned. I myself, hate flag burning but don't believe in getting rid of the 1st amendment or someone's right to burn one. I also don't want to prohibit anyone from flying a confederate flag. I don't get the whole confederate flag thing. they did betray the country ( an offense punishable by death) and wanted to keep slaves I don't think that's very patriotic. by the way, I know ALOT of conservatives that hate the confederate flag ,the whole flag thing isn't just a liberal thing. by even stating that all liberals believe this is an ignorant question. it's obious that you unrationally hate someone based on a belief structure (by the way some liberals are guilty of the same thing). that's a very sad way to go through life.

Free Speech was put in the Constitution to protect the people who were speaking out against their country and their politicians--this is why flag burning is protected.

Hate speech has never been protected and unfortunately too many people view the Confederate flag as a sign of hate instead of heritage and that is why states have done away with it. (Kind of like the people who think the Civil War was fought over slavery when in reality it was fought over State's Rights)

The Confederate Flag was used as the official symbol of a bunch of Americans who wanted to break away fromAmerica because they hated the system and wanted to support slavery & power to the few.

We prevented them from braking away, thus the Confederate States of America never became a country. It was a failed coup. Why do people want to fly a flag of a country that NEVER existed.

And why do Conservatives want to fly it. Abraham Lincoln was President during the Civil War, and I thought he was Conservative's favorite President? Lincoln CERTAINLY did not like the CSA Flag, and would NOT want it to be flown along with Old Glory. That's just like spitting on the stars and stripes, don't you think?

During the Civil War, it was the Democrats who were trying to break away. The north was mostly Republican. So really, all the Conservatives today are driving around with a Liberal's flag on their back windshield. Obviously, viewpoints have shifted, and today the Democrats would be the North and the Republicans in the South.

Democrats don't want that history. It was a dak point, and we just wish it to be gone. So please Conservates, get rid of your pro-Liberal, anti-American, fail coup flag. Don't idolize hate and anti-Americanism.

Why do fundamentalists protest abortion, but bring out a cheering section for an execution? Sorry, I thought one good rhetorical question deserved another.

Assuming you want a real answer, and this wasn't just a rhetorical question:

1. People have a right to protest as long as they're not harming anyone else. How does flag burning hurt you? It doesn't, unless you blunder too close to my protest and catch a flaming ember in the eye.

2. I, a Liberal, do not want to prohibit "people" from flying a Confederate flag. You can fly it at your own home if you like. It will look great with the rusted out clunker you've got on blocks in the front yard.

3. Governments, though, have a responsibility to represent ALL of their people. . . and flying a symbol that is so offensive to so many segments of the population over the state capitol is just wrong.

because the confederate flag represents a segregated nation. it also represents support for slavery. it is not the flag of any current nation, therefore, it should not be flown. the south lost, get over it.

that said, you have the right to exercise your very own freedom of speech and you may fly your confederate flag on your own home whenever you like. just don't be surprised when you get a mouthful of someone else's freedom of speech because of what it represents.

flag burning is merely a symbol of protest and falls under freedom of speech. in our free country, i may not agree with what you say, but i'll fight all the way for your right to say it. that is why it should be legal.

think of it this way...the majority of americans are not muslim, right? well, it would be the same as if the population voted to banish muslims from our country. most of the population may not be affected, and lots of them may support that, but it is directly contradictory to our Constitution. same with the banning of burning the flag. most people may be against it, but it is a constitutional right.
