Most states are now no-fault divorce states which means the courts can care less if you or your spouse cheat, my husband cheated on me and the courts could care less because it was no-fault state, but if your state cares (i wish Florida did) then i guess it would depend on the content of the phone calls and emails , if they are talking about how great a sexual experience the day before was and things of that nature the judge may consider that cheating, but i think a recorded phone call would hold up stronger than an email, because your ex could of made up the emails under your email address just to make it look like you were having an affair

If that is all there is and no physical contact I don't think it would "legally" be considered cheating. Morally but not legally. But if it went beyond email and phone conversations then the evidence of such could be used to show intent in a court of law. I hope this helps.

But to your wife/husband, who knows? Your spouse may consider that cheating and it shouldn't be what the law thinks, it should be what your partner thinks since they're who you're with.

I think it is some kind of cheating especially if it ends up "sex on the phone" but legally? I doubt it! Must have some evidence.
