My friend came over my house, and I own a couch/bething, and he broke it when he sat on it. It was an accident, but now its unusable on the right side. I haven't told him that he broke it yet, what should I do? We're short on money, so we don't really have the money to buy a new one, should he be forced to pay for it?

Just so you guys know, he wasn't REEALLY fooling around, he just sat on it kinda hard, almost hopped on to it. He heard the big **crack**, but told me he didn't break it. Later I ofund out he indeed DID break it. He isn't really fat or anyhting, hes like a gian, hes really tall, and kinda fat.

The piece of furniture is not defective, just not meant to be used harshly, which it accidently was.

Did he do something other than just sit on it? Maybe jump up & down on it (think Oprah)? If he just sat on it...perhaps you have a faulty piece of furniture and you should be thankful he didn't get hurt.

If money is tight, perhaps in conversation mention that the couch got broken the last time he was over. If he offers to pay, accept. If not, is your friendship worth getting worked up over?

Did he break the couch by doing something that he should not have been doing? (horseplay, jumping on it, or the like)

Did he just sit normally on the couch and it broke?

If he did something wrong, he should pay for the damages he caused. If he just sat on the couch like a normal civilized person, and it broke (either from a defect or wear) then he has no responsibility to pay for a repair.

He was a guest in your home, and normal wear and tear is a cost you pay for having friends visit.

If you went to a restaurant, and jumped up and down on a chair, and it broke, you would be responsible for the damage. If you sat in a chair normally, and the leg broke and you fell and injured yourself, the restaurant could be liable for your injuries. It is the same thing with a guest in your home!!

How did he break it and not know it? What if he denies it and says you broke it and want to blame it on him? Just a thought...

If your couch broke when he sat on it, I have a feeling that the couch wasn't in all that good condition in the first place. In which case, shame on you for trying to make your "friend" buy you a new couch. (Or is your friend really really heavy?)

If the above does not apply, ask your friend to pay for PART of the couch.

If he knows himself that he broke it and he approaches you with the accident that occured and is willing to pay for the damage than he is truly a friend. This is the ideal situation.

Now anything else around thins is suspect.
1. are you absolutely sure that he is the one that broke it?
2. if you are certain,...approach him like a friend and say..."hey dude, i gotta talk...the other day when you were here you broke the sofa".
3. If he denies it and you are absolutely, positively sure that it was him.....then he knows he did it too, and he's not being a true friend to you. He's actually going out of his way to get away with it and totally disrespecting you.
4. If he has shown his true face then....RAISE HELL. Take him to small claims court and do not let him get away with it. You'll feel like a fool the rest of your life.

Let's all hope it's the ideal I mentioned in the beginning though.

Don't come across like that to him or he won't. I'd just tell him (nicely) what happened and see if he offers to pay first. If he doesn't, then just ask him outright if he'll pay. If he still doesn't, take him to small claims court.

no he should not have to pay for it.It was a accident.I would just let it go.You dont want to hurt his feelings by telling him.Just save until you can afford to get another one,its not worth hurting someone feelings.
