I moved in June 27th, paid 1st and last months rent. On July 28th I paid for Aug. rent. I'm moving out on Aug 27th and my landlord kept all money paid him. He owes me and wont give it back. What can I do?

My rent was $350 a month. When I moved in I gave him a total of $700 which is 1st and last months rent. On July 28th I paid him rent for Aug. I'm moving on the 27th of Aug and he's keeping the other $350. Where can I go to see about getting my money back

Take him to small claims court if he refuses to pay you what you are owed.

It really depends on if you are on a month-to-month agreement or a lease and what state you live in. I would definately send a demand letter (send it certified) requesting the overpayment in your rent returned. If he is claiming it is for a "security deposit" then ask for an itemized list of the items (repairs, etc) he is deducting from this money. Try and work it out with him, getting everything in writing because you will need documentation if you end up in small claims court.

Did you sign a lease or just go month-to-month? You have to take him to small claims court. Go online to your county govt's website and you should be able to print the paper work off there. If not, then you will have to go to the court house to purchase it (not expensive). You may have to pay a server to deliver it to him and that costs anywhere from $40 to $50. You can ask for that back, by the way, when you go to court. Good luck.

Keep in mind, he may just not have the money. It may not be a situation where he is intentionally screwing you over, he may just be strapped for cash. I've found the best route to getting money back in an expeditios manner is to confront them in a non-confrontational way. Ask pleasantly "Listen, we both know I'm owed the money... Is it just that you don't have it right now? IF that's the case then I can wait a week or two without pressuring you.".
Kill them with kindness.

Was it a month to month? Did you give proper notice?
Post the details so you can get a decent answer.
If you are month to month, he owes you the money but he doesn't have to return it until after you leave.
File in small claims court.

You didn't mention whether you signed a lease. If you did, I'm sure there's something in it about breaking your lease and what will be charged if you do.
