ok you need to get a lawyer involved in this. but as far as i know that if any or both of the spouses accure any debt in the marriage even without in ones name. the other party is still responsible. a pre-nump is just procting your assets you had before the marrage.

prenuptial agreement is assents before the marriage, not during. All debt during the marriage is marital debt, to be split between both parties.
My farther in law and my ex husband took a 8,000 loan out, i had no part nor did i even know, i am going to have to pay half of that along with all of my ex husbands debts. That is just the ugly part of divorce.No one likes to think about that when entering what is supose to be a life time of love and commitment.

DID you sign any documents with her on these debts? R they just in her name? if so then YOU have NO responsibility at all to pay them off for her. As long as you have the agreement that protects you and these things are not a joint venture with both signatures you will be fine! Good luck to u So sorry your marriage didnt work for u!

this is a debt that was accumulated during the marriage not before...I would seek advice from a lawyer and what the laws are for your state.

Well you should work with your lawyers on that but if your a co-applicant on the card meaning your name is on the account you would be possibly help liable for the debt on the card jointly. Unless you have some way to prove her purchases where for her...again deal with the lawyers.

just like anything gained during the marriage is mutal property...so are the debts. But you need to talk to an attorney that is in your state...laws differ from state to state. Looking for a message board answer on this is kind of dumb dude!! But just like any other debt...if your name is on it, you will be held just as reponsible as she is.

if it has your name on and it is not covered in the prenup yes you are responsible so make sure this is covered in your divorce papers example what is her debt and your debt.
