we set up for him to pay child support in june he has only paid 100 dollars out of 204 a month he owes what will they do to him..he owes 2400 dollars in back pay and gratitieys will he go to jail and will i be able to talk to the judge dhs is setting the court date up threw child support services....

Not sure about the law and child support, but FWIW: (we were in horrible debt crunch years ago; eventually wound up having to file bankruptcy). If you're in contact with the people you owe money to, and are making some sort of honest attempt to pay them, they'll tend to be a little less ugly about the situation. We wound up paying off a hospital bill, $20 a month, for a couple of years....
The court might want to know WHY he's so deep in the hole. If it's a matter of sudden unexpected expenses (car breakdown, family illness/death) and you can document it, there might be some willingness to work out an adjusted schedule to catch up. If he's just been slacking off, or spending his money on doodads, though, he might end up spending future non-work hours in the slammer.

In MD, Judges keep men out on the streets even though some of these men owe over $20,000 in back child support.

I don't know about your state, but a judge will usually set a purge provision that has to be satisfied before sending someone to jail.

You should contact the local child support agency in your area. In addition, if you owes too much, the state Attorney General's office is a good resource to use as they will pursue additional actions for you. You want to also ask the child support agency and state Attorney General's office for help in locating any additional employment resources that he has (i.e., running his social security number, taxes, etc.).

No he won't go to jail. If you have a lawyer he can write him a letter threatening to send him to jail, which sometimes gives them an extra kick in the caboose. What they can do is attempt to garnish his wages. Which means they'll take the money out of his check ibefore he even sees it. So he won't have a choice; his only option will be to quit his job.

I doubt he'd go to jail. What good would that do for him or for you and your baby? If anything the state would garnish his wages and all the money will be directed to you and your baby. I hope you are using it wisely, though. I know too many people who abuse the system. Give your baby the best - don't spoil yourself.

I don't know the state you are in, but in california a man behind in child support won't go to jail, but he can have his driver's license taken away, which I think is really stupid.

You don't want him to go to jail.

If he goes to jail, he will pay $0. $100 is better then $0. Try to get it taken out of his paycheck.
