a friend of mine dated this girl thinking she was 18. when he found out her true age, he dumped her and has been going out with an older girl. Now, he is in jail facing rape charges because that stupid ***** is going around making up stories about him to get back at him. I'm trying to help out a friend of mine, so is there a way my friends and I who know he isn't that type of guy, to defend him through his lawyer

Yes, he is in trouble. He should take it to jury. If the girl is well developed (meaning a reasonable person would accept her as being 18) and he can prove she lied, his lawyer may be able cause a reasonable doubt in the jury. They only have to convince one juror.

Yes, always yes. When will boys ever learn to ask girls for an ID. This has been happening since the laws were made. He can only tell the truth and let God take care of the rest. It doesn't matter what the girl says, she lies, bad things will happen to her. I know a man that beat his wife for many years, no one believed or helped her. To make a long story short, she finally got away, then after 7 yrs, he will go to prison for life, the point is, she wanted no revenge. She left it up God.

Yes it is possible to still get into trouble, one of my best friends went through this, he dated a girl who turned out to be 15 while we were 22 and she said she was 19 as did the 4 of her friends that were with us the night we met them at a concert. They dated for 8 months I believe until she finally fessed up she was about to be 16, although in our state the legal age of consent is 16 it is bumped up to 18 if there is more than a 5 year age differance (you can be 16 and 21 but not 16 and 22) she got pregnant got and abortion with out telling him but did tell her parents to get the money for it and they pressed charges and he spent a year in jail. If he had known she was pregnant he woulda married her but he broke up with her with in a few weeks of find out her true age and that she had had an abortion.

This is a hard one to answer! It's all very legal! Yes he can get in a lot of trouble, especially if the girl is actually saying that he raped her. He or you and your friends have to prove, without a doubt that she consented to the sex. If you have any notes, emails or im's or anything in writing from her telling you about this before it happened or after it happened you should give them to the lawyer so he can use them at the trial. also, as many of your friends that can should offer to get on the witness stand and tell about how the girl lied about everything....good luck...

Girls like that one make it so hard for girls who were REALLY raped to get believed. Hopefully the laws in your state will allow for the girl to be put on the stand AND her parents. Where were they when she was seeing your friend? This really sucks for your friend, because if he is convicted, he will always have to register as a sex offender where ever he goes. High price to pay for a little nookie.
If nothing else, I hope this experience will teach his friends a lesson about too easy sex and always asking to see ID. If the girl looks less than 25 to them, get ID before proceeding. Underage girls today seem to be all about teasing and turning guys on and using their sexuality as weapons. Guys need to quit being so dumb and gullible. Start using their brains above the waist. No nookie is worth going to jail for and being labeled the rest of their lives.

Yes, statutory rape is a felony and he could go to jail. Even if she lied about her age, the law sees her as a minor, and him as criminally liable. It's a tough one, but a good lawyer should get him off on a plea, though he'll still have a record.

There is nothing you can do for the guy. If he has sex with a female under 18 than its rape. B/c according to law any one under 18 is not old enough to have sex w/someone over the age of 18 who is considered and adult.

Your friend may be out of luck... although you and your friends could help as character witnesses. Girls who lie about their age are pathetic... but the ones who lie and then use it as a means to get back at the guy are just plain biches... and they should also be considered criminally stupid. The who statutory rape thing is silly now-a-days because it is easy for a young woman to lie about her age... (We went to a concert and my friend was hitting on this chick who looked to be about 25... seriously... and she was with her mother who insisted that she was only 12... EEEEEK!!!!!)

He's in a way big heap-o-trouble. It's gone way too far already for the games the young lady is playing, and he's caught in the middle.

All you can do is file affidavits with the attorney attesting to his not knowing her age, and his personality, and hope like hell the judge will listen.

what a bad situation to be in..are there many people who can vouch for his ignorance in regards to her age?? i mean did she tell other people as well that she was a certain age?? i would find out as much as i can about this person. If someone tells sosmeone thayre a certain age, and theres no way this guy could have known, then how the hell can he get charged??
