If you have a valid lease for your apartment and have kept up your rent payments, call the police again and tell him you want to file charges against your landlord for breaking and entering, as well as burglary. Your landlord has no right to enter your apartment without notice or without you being there.

Just to make something clear: you have no ownership interest in the apartment. You signed a lease, that is all. You have an interest in possession of the apartment, but you do not own it. The landlord still owns the apartment.

that being said, they do not have a right to enter the apartment willy nilly and take your stuff. Talk to an attorney, as it sounds like this happened a couple days ago, the attorney will be more helpful then the police. As you probably want money back, go for civil court.

If the landowner entered your premises without your permission then its breaking and entering. Then it sounds to me like she stole and destroyed property belonging to you that is unlawful and/or wilful damge. These are criminal matters and should be taken up with the Police in your state. Before reporting the incident, you should consult with an Attorney as to your criminal and civil options.

When you file your report, make sure that you mention that your were away from the house at the time of the incident and at no time did you give the landowner permission to enter your house.

The question you'll need to answer is: Was your house locked and secure when you left? Did the landowner have a key to get in? These are questions that you need answers to if a proceedings against this person are to be successful.

Good Luck.

Go talk to the district atty. If they refuse to file criminal charges pursue it in civil court. That landlord has to follow the law in properly disposing of your property. Around here it is called burglary

check your lease as well because most of them say the landlord can enter the premises at any time therefore you wont have a B&E charge but you will have a criminal destruction charge and theft.
