ISPA contract in Romania.Is a JV (Consultant) oblige to hire the non key experts?

40 non key experts (not nominated in the tender period), who are working now in other companies, have submited their CV's under my company's contract. Can they work for me without hiring them? I will get the money from the contact based on their timesheets.
