Diamonds are cut by metallic instruments which contain no diamonds whatsoever. So, yes diamonds can be scratched. Indeed, you could smash a diamond into pieces with a simple hammer and anvil if you want. (PS: I do not suggest that you do this, as diamonds as quite expensive!).
As to your second question, humans have NOT created any substance harder than diamond, at least not in any usable form. This answer somewhat depends on your definition of a "substance" and of "hardness".

I think that cubic zerconium is harder than diamond. But if you try to scratch a diamond with a CZ you won;t be able to do it without specalized equipment since a diamond is so very hard.

Yes that harder diamond can always scratch softer diamond. But how to break "Carbonato" diamond into halfed? If memory doesn't fails me, it is generally using the smaller pcs of "Carbonato" diamond seeped inside the natural scratched area of big "Carbonato" diamond. Then, pressurized to force it to split off

Something doesn't have to be harder than the thing it scratches/breaks/etc. For instance, wood can go through concrete if it's shaped right and is propelled fast enough.
The hardest thing known to man is my ex-'s head.
