pretty at all..... i want her to seek professional help, "I am NOT hurt", however the time has come for Action. I didn't move knowing the law, two witnesses, reporting may, and I must research this, bring out he prison blues...I feel that my statement must NOT be made until I am entirely calm. I have a GREAT say in what happens. I am curious as to what you might think should be done here, jail and a fine? Otherwize? Trust me I AM listening. She has oveer 40 priors *various*, so I am leaning in the direction of Psych Eval and contiuance w/ whatever programme they decide.....

Frgive me, the autoirites were called immediately....I have some bacround in law, though from state to state, even county to county the demographs on tolerance or spitting on the siewalk on Tuesday against the olaw thigs are more prominent, this is the midweat, not entirely progressive though I AM.....and am listening to your answers, as well thank you for taking this time to reply.

You have no say it what the sentence will be. It is solely up to the State prosecutor and the Court. They will allow you to give your opinion, but in reality it is their decision.

You cannot request a psych evaluation of the defendant. It must be requested by the court or the defendant, in some states the prosecutor can request it as well, but only on consent of the defendant. If the defendant (or defense counsel) does not say that the defendant is no competent to assist in their defense there will be no evaluation.

My advice to you is cooperate with the prosecutor and tell them how you feel, but let them decide the appropriate course of action.

ever since ronald reagan trashed the mental health system we have had people like this running loose. it's a shame but it's going to take an act of congress to change this problem, and that does not look to be forthcoming.

this evening seattle news reported on a man that's been terrorizing a neighborhood. people are afraid of him. (he's in a wheelchair). police don't want anything to do with him, they cannot deal with him, he has medical conditions and is very disruptive. amazing. they're going for a competency hearing (too little, too late).

as for your situation, i think it comes down to the good of the many outweighing the good of one. should this person be allowed to run rampant, assaulting others? i don't think so. but most jails are full so the woman will not be held long. i'm sure your local system, like mine, would rather jail people for pot possession and alcohol related offenses as there is more money in it for the city and or county.

in the end, you are not your sister's keeper. or are you?

I think you really need to consult a lawyer on this one. There might be some "time is of the essence" issues here. In other words, if you want her prosecuted, her lawyer may attack you by saying that you didn't report the crime in a timely manner. I'm not an attorney so I don't really know. However, you really do need to know what to do in this situation, and waiting might not be it.
Also, part of your statement is indecipherable so I am thinking that you are not in the best mental state right now to be making legal decisions. Please see a lawyer.

If you were assaulted you really should report it.
and Let the police deal with.

You are better off reporting it right away than later, as its fresher on your memory.

You have no say in Jail or fine. or treatment.
